CJM Issues Non-bailable Warrant Against Police Officer

The Court of Chief Judicial Magistrate Srinagar Saturday ordered non-bailable warrant against Senior Superintendent of Police, Srinagar, for not obeying court order to register FIR against a DSP for allegedly killing a youth in Batamaloo in the city. 1038428-arrested_x-1454359259-540-640x480
Chief Judicial Magistrate (Srinagar), Masarat Shaheen, issued a non-bailable warrant against SSP Srinagar. The CJM directed DIG Central Kashmir range to execute the order.
The court rejected the application on behalf of SSP Srinagar seeking exemption from the personal appearance.
The chief prosecuting officer, on behalf of the SSP, had sought exemption from his personal appearance for today’s hearing on the facts that SSP is busy in law and order situation in the valley and this is unable to appear before the court.
The CPO had also stated they are going to assail orders of this court dated 18.07.2016 and 28.07.2016 as such the SSP Srinagar may the exempted.
As per the directions of the court, SSP Srinagar on July 18 and 28 was directed to lodge an FIR against the non applicants mentioned in the application.
The CJM observed that the SSP was also directed to furnish the copy of FIR within 24 hours but despite these two directions SSP Srinagar has neither lodged the FIR till this time against the non applicants and nor he has filled a copy of FIR within 24 hours, hence has flouted the Court directions.
“Thus the application moved on behalf of the SSP Srinagar is rejected. Hence a non bailable warrant is issued against SSP Srinagar through DIG Central Kashmir with the direction to CPO to forward the warrant to DIG Central Kashmir and file compliance report within two days time,” the court directed.
“The SSP Srinagar is further directed to show cause as to why contempt proceeding shall not be initiated against him for not obeying the court direction whereby he was directed to lodge the FIR and file the copy of FIR within twenty four hours,” the CJM directed. The next hearing of the case is listed on August 1.
A youth in Batamaloo, Shabir Ahmad Mir, was killed by the police in the ongoing unrest. The youth’s father filed an application in the CJM and accused a DSP for “killing his son in cold blood”. (KNS)
