The news item captioned “Tainted DG ISM holding six charges” Published on 27th September 2016 publication of news-paper ‘Daily Early Timesis based on false, concocted and misrepresented facts. At the outset it is to state that the word “tainted” apparently used in the headline is irrelavent, unrealistic, deligatory which amounts to slanderous and attracts penal provisions of law of libel.
The allegations levelled in the news item are vehemently denied being false and fabricated. The allegations are false and is handiwork of mischievous and miscreants. The motive of mudslinging and spreading venom against Department is to lower the image of Department in the estimation of general public. Such elements need to be discouraged which could done by verifying the facts narrated by them before publication. Reputations are build in decades which can be demolished in no time by defamation as in the instant case, therefore it is the forecast obligation cast upon every soul to verify the facts before publication. One must proceed with circumspection while publishing narrations as it can damage the inestimable repetitions and thereby will have serious legal implications.
The brief facts are delineated as under:-
- Regarding allegations of holding 6 posts:-
The allegation that undersigned is holding six posts is vehemently denied. As a matter of fact the undersigned is holding only one post i.e. Director General. MD, NAM/CEO are ex-officio assignments attached with the post of HOD and are not separate or sanctioned post.
- Allegations of Embezzlement of Rs. 5.0 Crores in Vanaspati Van:
The total project cost for 5 years was 3.00 crores aprox. The project stands closed in 2009 by Govt. of India and was executed by Forest Department through its Officers DFO/ACF designated as Project Managers. The information sought by investigating agency was provided to them and nothing adverse has been established.
- Allegation of spurious drugs:Anonymous complaints engineered by mischief mongers and disgruntled elements has been filed before the Crime Branch Kashmir. Investigating agency has investigated the matter and nothing has been established against the department in this behalf.
- Allegation of selling of Diploma Certificates, Order of Enquiry issued by State Vigilance Commission Vide No. SVC 167 dated. 10-09-2013, Order of Enquiry issued by HE Governor of J&K & Public Interest Litigation:
The Adm. Department of Health & Medical Education acted promptly on these complaints by constituting Enquiry Committee vide Govt. order No. 03-HME of 2014 dated. 02-01-2014. The committee after conducting the in-depth enquiry and nothing wrong was found. The enquiry report submitted by the committee has been accepted by the Government vide G.O. No. 434-HME of 2014 dated. 21-07-2014 and allegations leveled by the complainant found without substance. Pertinently Hon’ble Governor not issued any instruction for enquiry.
The Government has filed the objections in the PIL before Hon’ble Court. No adverse orders have been passed by the Hon’ble Court, SVO has also filed its status report and nothing has been found against the undersigned.
Selling of Diploma Pharmacist Certificates against hefty amount is baseless, imaginary and bald allegations which is defamatory.DG ISM is not appointing authority, appointments if any made in NHM is made by District Health Societies not by Dr. Kabir.
- Allegation of Enquiry registered with VOK vide No.11/2015 for alleged purchase of spurious drugs:
The complaint is baseless and whatever information/records were sought by VOK has been provided and nothing adverse has been established.
- FIR registered with VOK vide No. 43/2015 and swindling state exchequer by illegal construction of Hospital at Harwan Srinagar:
The executing agency is PWD (R&B) Kashmir. The Director General ISM has no role in execution of work which is wholly and solely within the domain of executing agency. As regards allegation of swindling of money the same is denied vehemently as the DG ISM has no role in execution of work. Case is subjudice before Hon’ble High Court.
- Enquiry registered with Vigilance Organization Jammu vide No. 4054/VOJ for purchase of spurious drugs for 2016:
The department came to know through newspaper dated:-10-09-2016 that two medicines Cap. Prostate Forte &KaishoreGuggul in a few dispensaries had allegedly developed fungus. The department acted swiftly and an enquiry in this regard has been conducted by the department through a committee of senior officers. The committee has submitted preliminary report and has found that there is no deviation from prescribed procedure in procurement of medicines. No complaint from any quarters has been received against said drugs. However, I/c Officer of these Dispensaries has not furnished any such report of development of fungus in these two medicines. There I/c Medical Offices have been placed under suspension pending enquiry and enquiry underway. As soon as enquiry report is received responsibility will be fixed and action under law will be taken against the defaulters. The reply has been accordingly submitted to Vigilance Organization.
- Promotions scam elevating Junior medicos to higher posts while bypassing the seniority of other aspirants:
No medical Officer has been promoted by the Directorate to any senior position. It is the DPC/PSC which clears the promotion of suitable officers to the post of ADMO/Deputy Director and formal orders of promotion are issued by Administrative Department (Government).
- Probe into alleged Sex Racket at Unani Hospital Shalteng:
No Sex scandal as alleged has taken place at Unani Hospital Shalteng. As a matter of fact one Dr. Javid Ahmad Mir, Medical Officer (Unani) was arrested on 22-04-2016 at 11 PM by Police Station Sumbal for having allegedly molested a relative lady at Village AjasDistrict Bandipora which is 80 kms away from Unani Hospital Shalteng. An FIR to this effect was lodged by Police Station Sumbal under FIR No.62/2016 376 and 342 RPC P/S Sumbal. Detailed report has been submitted to Government in this behalf.
Thus the news/complaint which appeared in the Daily Early Times is malicious, defamatory, misplaced, unfounded, engineered, manipulated, false and fabricated and merits dismissal. The complainant having criminal tendency has triggered misinformation complain and has manufactured the complaint by artful skills to defame the Department and the undersigned in the eye of public at large and higher authorities. The correspondentSaqib Ahmad who has mislead your esteemed newspaper to public unverified report without getting same verified/cross checked from the department is liable for penal action for defamation.
